2. Petitioners seek regular bail in connection with S.Tr. No. 57 of 2025 arising out of Panapur P.S. Case No. 213 of 2024 dated 01.07.2024 registered for the offences punishable under Sections 115, 117, 109, 352, 118(1), 103(1) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The main submissions advanced by petitioners’ counsel are that this is a second attempt of the petitioners to get the relief of bail, their earlier prayer was rejected vide orders dated 28.02.2025 and passed in Cr. Misc. Nos. 7390 of 2025 and

Cr. Misc. No. 12216 of 2025 giving them liberty to renew their prayer for bail after framing of charges upon them, accordingly, they have renewed their prayer in the light of the said liberty as charges have been framed upon them, the fresh grounds in addition to the said liberty for renewing the prayer are the petitioners’ custody period which has been about ten months in respect of petitioner no. 1 and about nine months in respect of petitioner no.2 and secondly, most of the co-accused persons namely, Ranju Devi, Shanti Devi, Brij Kishore Raut, Raj Kishore Raut and Suraj Raut have been granted bail by the learned co-ordinate Benches of this Court vide orders dated 31.01.2025, 07.03.2025, 19.03.2025, 09.05.2025 and 13.05.2025 passed in Cr. Misc. Nos. 938 of 2025, 71480 of 2024, 16849 of 2025, 19559 of 2025 and 14375 of 2025 respectively and the case of both the petitioners’ stands on similar footing with the co-accused persons Suraj Raut and Brij Kishore Raut. It is further submitted that both the petitioners have fair and clean antecedent and both parties are agnates and a land dispute running in between both the parties at the time of the alleged occurrence is said to be the genesis of the occurrence.

for bail of the petitioners.

Considering the aforesaid submissions and mainly petitioners’ custody period and also the facts that several coaccused persons have been granted bail in whom some are carrying the similar nature of allegation and also the fact that their trial has started, in my opinion, both the petitioners now deserve to the relief of bail. Accordingly, let the petitioners named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with S.Tr. No. 57 of 2025 arising out of Panapur P.S. Case No. 213 of 2024.
