The petitioner is the husband of the opposite party no. 2 who seeks anticipatory bail in connection with Complaint Case No. 1511C of 2023 registered under section 323, 498A, 379 of the I.P.C. and section ¾ of the D.P. Act.

As per the complaint petition the marriage of the complainant was solemnized with the petitioner on 14.05.2012 and out of the wedlock four children were born. It is alleged that after some time the petitioner started torturing the complainant for Rs. 5 Lakh or a four -wheeler. Thereafter, she returned to her “miayake’ and when Rs. 1 Lakh was given to her father-in-law her husband took away her to “sasural” but after some time all

the family members of her “sasural” started torturing her. Eventually, on the fateful day of 05.08.2023 the accused persons ousted her from the matrimonial home.

The matter was referred for mediation by this court by order dated 12.02.2025 and as per mediation report dated 01.05.2025 dispute between the parties has been resolved and the terms of settlement has mutually been agreed and signed by them on 01.05.2025.

Having regard to the submission made by the parties, taking into consideration the fact parties have arrived at amicable settlement and the terms and conditions of settlement has been reduced to writing before the learned Mediator on 01.05.2025, as such, I am inclined to grant anticipatory bail to the petitioner subject to the condition that both the parties shall abide by the terms and conditions dated 01.05.2025.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1^st Begusarai in connection with Complaint Case No. 1511C / 2023 subject to the condition as laid down under
