Heard learned counsel for the petitioners and Mr.

Madhura Nand Jha, learned APP for the State.

The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

The case of the prosecution is that 7 unknown miscreants have entered in the house of the informant. They had made fire and took away valuables from the house of the informant.

Learned counsel for the petitioners have submitted that the FIR was lodged against unknown miscreants. During course of investigation, the name of this petitioners have surfaced on the confessional statement of co-accused. Save and except the confessional statement and criminal antecedents, there is nothing against the petitioners to implicate him in the present case. The petitioner in Cr. Misc. No. 40583 of 2025 is in judicial custody since 09.09.2024, petitioners in Cr. Misc. No. 43026 of 2025 are in judicial custody since 23.08.2025 and petitioner in Cr. Misc. No. 44408 of 2025 is in custody since 23.11.2024. One of the co-accused has already granted regular

bail the co-ordinate Bench of this Court vide order dated 08.08.2025 in Cr. Misc. No. 48210 of 2025.

Learned APP for the State has vehemently opposed the application for bail.

On perusal of materials available on record and impugned orders, it appears that nothing available against the petitioner in this case. No recovery from the petitioners and investigation concluded accordingly charge-sheet submitted. Considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Jale P.S. Case No. 113 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of concerned Court, Darbhanga subject to the condition that petitioners shall remain present physically each and every dated fixed by the trial Court till conclusion of the trial.
