3 16-10-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners apprehend arrest in connection with Muffasil PS. Case No. 125 of 2025 dated 15-04-2025, instituted under Sections 189(2), 191(2), 190, 126(2), 115(2), 109(1),117(2) 118(1), 303(2), 74, 352, 351(2) of the BNS 2023.

3 .The prosecution case, in short, is that the FIR-

named accused persons, along with the petitioners, forcibly entered the informant’s house, abused and assaulted her daughter and threatened her to withdraw an earlier case ( Muffasil PS Case No. 89 of 2025) related to outraging her daughter’s modesty. It is alleged that petitioner no.1 assaulted the daughter of the informant with a bamboo stick, causing injury on her head and left hand whereas petitioner nos.1 and 5 pulled her clothes and petitioner no.4 snatched the informant’s gold chain and earrings.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in the present case. It is further submitted that there is a specific allegation against petitioner no.1, who is alleged to have assaulted the informant’s daughter and the informant with a bamboo stick on their heads. However, the injuries sustained by both injured are stated to be simple in nature. The allegation against petitioner no.5 relates to outraging the modesty of the informant’s daughter. It is further submitted that, as far as the other petitioners are concerned, the allegations made against them are general and omnibus in nature. Lastly, it is submitted that petitioner nos.1, 4, 5, 6, and 7 have no criminal antecedents, whereas petitioner nos.2 and 3 have one criminal case pending

against each of them.

Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of

the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Begusarai, in Muffasil PS. Case No. 125 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
