Heard Learned Counsel for the petitioner and Learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sessions Trial No.28 of 2024 arising out of Piprasi P.S. Case No. 51 of 2023 lodged on 08.10.2023, for the offence punishable under Section 366A of the Indian Penal Code.

Learned Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 09.04.2024 passed in Cr. Misc. No. 6700 of 2024 with specific direction to the Trial Court to expedite the trial and conclude the same as early as possible. Counsel submits that petitioner is in custody since 10.10.2023 having clean antecedent.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that as per the statement of the victim recorded under Section 161 of the Cr.P.C. and under Section 164 of the Cr.P.C., it shows that petitioner kidnapped her and committed rape.

In this view of the matter, this Court is not inclined to grant regular bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
