The petitioner is apprehending his arrest in connection with Complaint (0) Case No. 06 of 2018 dated 26.11.2018 registered for the offences punishable under Sections 120B, 177, 193, 465, 467, 468 and 471 of the I.P.C.

As per the prosecution case, as per the Letter No. 1334/2018 of the learned Juvenile Justice Boards, Jehanabad and Arwal, it has been alleged that the petitioner being the father of one Kundan Kumar, who was an accused in connection with Makhdumpur P.S. Case No. 222 of 2018 and Makhdumpur (Tehta) P.S. Case No. 217 of 2018, got issued his forged transfer certificate in conspiracy with the co-accused Braj Kishore

Chaturvedi, the Incharge Headmaster of Upgraded Middle School, Barawa, Kako, by mentioning the date of birth of his son Kundan Kumar as 10.03.2004 whereas on proper verification from the office of the District Education Officer, Jehanabad, the learned Juvenile Justice Board found his real date of birth as 04.01.1999.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is an illiterate person and he has no hand in the alleged creation of forged document. The said forged transfer certificate has been issued by the In-charge Headmaster and the petitioner has no knowledge with regard to wrong entry of date of birth has been made, so, the petitioner is not responsible for the same. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.

Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs.

20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Jehanabad in connection with Complaint (0) Case No. 06 of 2018, subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023.
