Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Barhara P.S. Case No. 50 of 2025, registered for the offences punishable under Sections 120(2), 115(2), 109, 103(i), 74, 3(5) of the BNS.

The informant Harendra Singh, makes allegation that while he was going to his village with his gun, co-accused Ravindra Rai @ Doctor came there and demanded his gun to see it, during which the trigger was pressed. On hearing the sound of firearm, coaccused Navin Rai, Buchi Rai, Dharmendra Rai, and Vikash Kumar @ Rinku Yadav (the petitioner) started assaulting the informant with the butt of his own gun, causing injuries to him. Thereafter, Prem Singh @ Bare and other villagers came there to rescue the informant and in course of the rescue, Prem Singh @ Bare opened fire, which

hit Dharmendra Rai, resulting into his death. Thereafter, Navin Rai, Buchi Rai, Vikash Kumar and 5–10 unknown persons started assaulting Prem Singh @ Bare. It has further been alleged that coaccused Navin Rai and Buchi Rai committed the murder of Prem Singh @ Bare by thrashing stone boulders on his chest. It has been mentioned in the FIR that prior to this occurrence, on 10.03.2025, coaccused Navin Rai had molested a girl belonging to the Chandrabanshi community and the accused persons were creating hindrances in the way whenever the co-villagers of the informant were passing from the village of the accused persons.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of killing Prem Singh @ Bare is against Navin Rai and Buchi Rai by thrashing stone boulders. Co-accused Ravindra Rai @ Doctor, Navin Rai and Vikash Kumar have already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 38047 of 2025 and the case of the petitioner on better footing.

On the other hand, learned APP for the State has opposed the prayer for bail but fairly conceded this fact that coaccused Ravindra Rai @ Doctor, Navin Rai and Vikash Kumar have already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 38047 of 2025. The allegation against the petitioner is general and omnibus.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, Ara in connection with Barhara P.S. Case No. 50 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
