The petitioner has preferred this application for

grant of regular bail in connection with Chiraiya P.S. Case no.107 of 2025 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on seeing the police personnel, it is stated that the petitioner made and attempt to escape with a bag but fell down. He was caught and on search 60 litres of liquor was recovered from the bag which the petitioner was carrying.

Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner’s possession who has been falsely implicated in the case. He is in custody since 8.3.2025 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., his being in custody for 3 months since 8.3.2025, charge-sheet having been submitted in the case and especially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Chiraiya P.S. Case no.107 of 2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no.1, Motihari, East Champaran.
