Heard learned counsel for the petitioner and learned

APP for the State.

The petitioner seeks regular bail in connection with Laukaha P.S. Case No. 224 of 2020 for the offence registered under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

As per prosecution, total 148 litres Nepali liquor was recovered from the school. Allegation against the petitioner is that he has kept the said seized liquor in the school.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He has no concern with the place of occurrence of seized liqour. There is no recovery from the conscious possession of the petitioner. Although the petitoiner has four

criminal antecedent but the same do not belong to the excise Act. Charge-sheet has already been framed in this case. Petitioner is in custody since 14.03.2025 and he undertakes to cooperate in the trial.

Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Laukaha P.S. Case No. 224 of 2020.
