learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Garkha P.S. Case No. 607 of 2024 registered for the offences punishable under Sections 115(2), 118(1), 126(2) and 109(1) of B.N.S

As per prosecution case, petitioner and other surrounded the informant and it is alleged that co-accused Sambhu Manjhi assaulted the informant by means of farsa and petitioner assaulted the informant by means of hasauli as a result of which informant sustained injury on hand. It is further alleged that co-accused Amit Manjhi assaulted the informant by means of rod on his head and upon instructions of Brij Kishor Manjhi, several other co-accused persons namely Bittu Manjhi,

Hans Manjhi and Abhishek Manjhi assaulted the informant indiscriminately by means of hockey stick.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. Petitioner bears no criminal antecedent. It is further submitted that there is a counter version of occurrence also vide Garkha P.S. Case No. 614 of 2024 registered under sections 126(2), 115(2), 351, 352, 3(5) of the BNS and Section 3(i)(r)(s)/3(2)(va) of the SC/ST POA Act and it seems that for mounting pressure on the petitioner’s side, present case has been lodged. Informant has not made any specific allegation against the petitioner that he assaulted on the head of the informant. The specific allegation of assaulting informant by means of rod upon his head is against co-accused Amit Manjhi. Learned counsel further submits that there is specific allegation against the petitioner to assault the informant on hand but the said injury is merely abrasion as is evident from the injury report contained in Annexure-2. The said injury is not on the vital part of the body.

The learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that petitioner is said to have assaulted upon the hand of

the informant and petitioner cannot escape from the liability of the same.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Saran at Chapra in connection with Garkha P.S. Case No. 607 of 2024, subject to the conditions as laid down under Section 482(2) of B.N.S.S.
