Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Chandi (Wena) P.S. Case No.64 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 303(2), 109, 352, 351(2) and 3(5) of B.N.S.

As per prosecution case, petitioner and others is said to have assaulted the informant’s son, Karan Kumar, upon his head by means of lathi, brick, danda and axe as a result of which he sustained injury on head and informant’s son, Kundan Kumar, was assaulted by means of bricks upon his thigh.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and petitioner being father of two co-accused persons

has falsely been implicated in this case. Petitioner bears no criminal antecedent. Learned counsel for the petitioner submits that petitioner is not assailant as it is revealed from the restatement of the informant as well as the statement of victims namely Kundan Kumar and Karan Kumar rather the specific allegation of assault is against co-accused Mithun Ravidas. Allegation against the petitioner is general and omnibus in nature. Injured Karan Kumar has sustained grievous injury caused by hard and blunt substance whereas injured Kundan Kumar sustained simple injury caused by hard and blunt substance. In the light of aforesaid facts and circumstances, no offences is made out against the petitioner.

The learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, there is no specific allegation of assault against the petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.
