Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Singhia P.S. Case No. 132 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 303(2) and 3(5) of the B.N.S.S.

Allegedly on the fateful day while the tree plantation was going on under the Government scheme, on account of some dispute, the petitioner alongwith others came to the house of the informant and it is specifically alleged that the petitioner gave iron rod blow over the head of the informant, as well as his father. When the mother of the informant came to

their rescue, she was also assaulted.

Learned Advocate appearing on behalf of the petitioner contended that there is a counter version of the present case being Singhiya P.S. Case No. 133 of 2024 instituted by the wife of the petitioner. The petitioner and the informant are own gotiyas and there is old rivalry between them . The informant and his family members also bear criminal antecedent; moreover, the occurrence took place on the premise of a land dispute and only on account of past criminal antecedent, the name of the petitioner has been implicated in this case.

On the other hand, learned Advocate for the State as well as informant opposed the pre-arrest bail application and submits that apart from the specific allegation of causing iron rod blow over the head of the informant and his father, the injuries have also been found to be grievous in nature, as is evident from the impugned order.

Regard being had to the submissions made on behalf of the parties and considering the specific nature of accusation of causing grievous injury to the informant, as well as his father, coupled with his criminal antecedent in eight cases, this Court is not acceded to the prayer for anticipatory bail and
