A supplementary affidavit has been filed in respect of criminal antecedent of the petitioner, which is taken on record.

Heard learned counsel for the petitioner and learned

APP for the State.

In the present case, the petitioner seeks bail in connection with Bikram P.S. Case No. 310 of 2024 registered for the alleged offences under Sections 140(3), 96 read with 3(5) of B.N.S.

As per prosecution case, the informant gave a written report about her step mother and the petitioner, who is nephew of her step mother, that they had taken away the sister of the informant along with all land record and some ornaments, tablet, mobile and keys of the house.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

case. No occurrence as alleged has ever taken place. The allegation against the petitioner is false and concocted. The victim girl has been recovered and she made statement before the learned Judicial Magistrate that she wanted to stay with her step mother. She also stated about her father that he used to regularly beat her and her mother. Due to cruel behaviour of the father of the informant, his earlier wife left him. The present case has been lodged by the informant at the instance of her father. The false implication is also apparent from the facts given. The date of occurrence is stated to be 18.07.2024 but the FIR was lodged on 30.07.2024 and there is no explanation for the said delay. The step mother of the informant has not made any allegation against the petitioner. The allegation levelled against the petitioner is absurd and false. The petitioner is in custody since 24.02.2025 and charge sheet has been submitted. The petitioner has got antecedent of two cases.

Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation and also considering the period of custody of the petitioner and submission of charge sheet, the

petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Danapur, Patna /concerned Court in connection with Bikram P.S. Case No. 310 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

¶25

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
