Heard Mr. Shashwat Sahil Singh, learned counsel for the Petitioner and Mr. Bhanu Pratap Singh, learned APP for the State.

2. Petitioner seeks regular bail in connection with Mirganj P.S. Case No. 369 of 2024, dated 27.08.2024, registered for the offences punishable under sections 87, 96 & 64 of the Bharatiya Nyaya Sanhita (in short ‘BNS’) and Sections 4 and 6 of the POCSO Act.

The main submissions advanced by petitioner’s counsel are that the petitioner is not named in the FIR, in fact the informant’s daughter, the victim had love affair with one Manish who is named in the FIR and she went with him and thereafter, the said Manish Kumar kept the informant’s daughter in the petitioner's house as the petitioner had friendship with Manish Kumar at that time and thereafter, the police recovered the victim from the petitioner’s house and only on that basis the petitioner has been made an accused in this case. Further, the victim made some allegation against this petitioner in her statement recorded

under section 183 of the BNSS in order to save his lover Manish Kumar, though, initially in the first part of her statement she accepted her love with this petitioner also. It is further submitted that petitioner has clean past history and he has never remained involved in any criminal offence or activity prior to the registration of the FIR of the present matter, he has been languishing in jail since 13.01.2025 and against him the investigation has been completed.

4. Learned counsel appearing for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions, and mainly the petitioner’s fair and clean antecedent, his custody period and the completion of investigation against him, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Mirganj P.S. Case No. 369 of 2024.
