assisted by Ms. Ritika Kumari, learned Advocates appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

The petitioner apprehends her arrest in connection with Siwan Town P.S. Case No. 61 of 2023, registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.

Based upon the written report the prosecution alleged that in course of employment on the post of lady supervisor, the petitioner alongwith other candidates were found involved in submitting forged and fabricated certificates, based upon which they have claimed their appointment.

Learned Advocate appearing on behalf of the petitioner submitted that the very institution of the FIR is based upon the communication given by the Chaudhary Charan Singh University. It has only been apprised that the enrollment number as has been disclosed in the certificate of the petitioner, did not find in its record. The petitioner has neither been afforded any opportunity to rebut the allegation, nor allowed to produce the papers, and the FIR came to be lodged in a hot and haste manner. It is the admitted position that the petitioner is a candidate who did not secure the appointment and, in fact, she is herself a victim of the circumstances that her certificate is said to be forged and fabricated, irrespective of the fact that she pursued her course and obtained the certificate. Be that as it may, the petitioner is lady having fair antecedent and she undertakes before this Court that she will cooperate in the investigation and the proceeding of the Court.

On the other hand, learned Advocate for the State opposed the pre-arrest bail application.

Regard being had to the submissions made on behalf of the parties and considering the materials available on record, specially the fact that the petitioner is a lady having fair antecedent and the entire case is based upon documentary

evidence, let the petitioner above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 61 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
