1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 395 and 397 of the IPC and Section 27 of Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that while he along with Shamshad, after closing his jewellry shop, were returning on a motorcycle, when they were intercepted by five unknown accused persons, who assaulted and even fired causing injury to Shamshad and took away the motorcycle, Rs. 5,000/-, a golden chain etc., as detailed in the FIR and one of the accused also stabbed him.

petitioner has been falsely implicated in the instant case by the informant. It is next submitted that his name transpired in the confessional statement of Simant Singh in police custody, which does not have any evidentiary value. It is also reiterated and submitted that petitioner is a person with clean antecedent. It is further submitted that similarly situated co-accused Ritik Kumar had approached this court seeking anticipatory bail by filing Cr. Misc No. 83376 of 2024 and the same was allowed by an order dated 11-12-2024 by a learned Co-ordinate Bench.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the fact that similarly situated co-accused has been granted the privilege of anticipatory bail by a learned Co-ordinate Bench, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goreakothi P.S. Case No. 63 of 2023, subject to

the conditions as laid down under Section 482 (2) of the BNSS.

7. One of the bailors of the petitioner shall be his
