the petitioner and Mr. Sanjay Kumar Sharma, learned APP for the State.

The petitioner has renewed his prayer for grant of regular bail in connection with Indusrial Area P.S. Case No. 9 of 2024 registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code which was earlier dismissed as withdrawn by this Court vide order dated 23.01.2025 passed in Cr. Misc. No. 76890 of 2024 with liberty to renew his prayer for bail after three months.

The case of the prosecution is that the minor daughter of the informant has gone to Chakam Karan Bazar. When she did not return for a considerable moment, she was being searched by her family members. During course of

investigation, the victim was recovered and she has given her statement under Sections 161 and 164 of the Cr.P.C. as well. In her statement under Section 164 of the Cr.P.C., the victim has sated that the petitioner and one Manjit Kumar forcefully boarded her in a train and from there Manjit Kumar took her to Pune. She was kept in a house and she was forced to do household work. She was also being assaulted.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The informant and the petitioner are relative. From perusal of the statement of the victim also it transpires that the main thrust of allegation is against Manjit Kumar. Learned counsel has also submitted that parties have compromised the case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 08.07.2024.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 9 of 2024.
