This is the bail application of the petitioner seeking

his regular bail in connection with Sahebpur Kamal P.S. Case No.381 of 2024 registered for the offence under Section 25(1-b), 26 of the Arms Act.

According to the case of prosecution, on the date of incident i.e. on 15.11.2024 it is alleged that on the basis of information received from the informant, the S.H.O. of the said Police Station caught hold the present applicant and on being searched, two country-made pistols along with 23 cartridges have been recovered from his possession.

It is submitted by the learned counsel for the petitioner that petitioner in innocent and has falsely been implicated in this case. He is in custody since 16.11.2024. He

further submits that charge sheet has already been filed in the present case, therefore looking into the detention period of the petitioner in this case, it is prayed that he may be granted benefit of regular bail.

Learned counsel for the State opposes the arguments raised by the counsel for the petitioner and submits that since there were five criminal antecedents available against the petitioner, therefore on this ground, the petition may be rejected.

Considering the submissions made by the counsel for the petitioner and particularly considering the detention period of the petitioner, I am of the view that it is a case where the petitioner should be granted benefit of bail.

Accordingly, the application is allowed.

The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-JudgeIV-cum-A.C.J.M.-IV, Begusarai in connection with Sahebpur Kamal P.S. Case No. 381 of 2024.
