The petitioner seeks bail in connection with Turkauliya PS Case No.374 of 2024 dated 02.09.2024, instituted for the offence punishable under Sections 126(2), 115(2), 103, 109, 61(2), 352, 351(2) of the Bharatiya Nyaya Sanhita , 2023.

The allegation against the petitioner is that he abetted and instigated his son, Sujit Kumar, to kill the informant’s brother, Sunil Kumar Thakur, upon which he gave repeated blow on his head by means of bamboo due to which he sustained injury and died during the course of treatment.

Learned counsel for the petitioner submits that the

petitioner is an old man aged about 60 years. He happens to be

the father of the main accused, Sujit Kumar, who assaulted the brother of the informant on his head by means of bamboo. Further submission is that there is no specific allegation either of assaulting the deceased on in participating the crime. He is only an order giver. Lastly, it is submitted that the petitioner is in custody since 16.12.2024 having clean antecedents.

Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, East Champaran, Motihari, in Turkauliya PS Case No.374 of 2024.
