Heard Mr. Rajeev Ranjan, learned counsel for the petitioner and Mr. Murli Dhar, learned APP for the State.

Petitioner seeks regular bail in connection with Piar P.S. Case No. 249 of 2023 dated 21.11.2023 registered for the offences punishable under section 366(A)/ 34 of the Indian Penal Code.

The main submissions advanced by petitioner’s counsel are that the petitioner is a 24 years young person, the alleged occurrence is said to have taken place on 11.08.2023 but the FIR was lodged on 21.11.2023 after a delay of three months and ten days by the informant, who is the father of the so-called victim, despite the factum of disappearance of the victim having come to the knowledge of the informant immediately on

11.08.2023, in fact the petitioner and the informant’s daughter solemnized their marriage and they have sworn an affidavit before a notary public copies of which have been filed as annexure-2. It is further submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 12.11.2024 and against him the investigation has been completed and as per the educational certificates of the victim filed with this petition the said victim was a major girl at the time of the commission of the alleged offence.

Learned APP for the State has opposed the prayer of the petitioner.

Considering the facts and circumstances of this case as well as aforesaid submissions and mainly the petitioner’s young age and his custody period and also the completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner namedabove be released on bail on furnishing bail bond of Rs.20,000/(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Piar P.S. Case No. 249 of 2023.
