Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No. 278 of 2024 arising out of Manpur P.S. Case No. 7 of 2023 instituted for the offences under Sections 341, 447, 302, 307, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that accused persons including the petitioner have fired indiscriminately upon the informant and his family members and as a result of which son of the informant died on the spot.

Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the

present case due to previous land dispute. Learned counsel further submitted that name of the petitioner is being dragged in this case merely because he is the father of the co-accused persons. There is no specific allegation against the petitioner. No incriminating article has been recovered from the conscious possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.10.2023 and has five criminal antecedents. The co-accused person has already been granted bail by this Court vide order dated 08.05.2024 passed in Cr. Misc. No. 3883 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that there is specific allegation against the petitioner that he along with Soni Singh and Sushant Singh fired indiscriminately upon the informant and his family due to which the son of the informant died on the spot.

Considering the aforesaid facts and circumstances of the case as also there being specific allegation against the petitioner of firing, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.

Learned Trial Court is directed to expedite the trial.

However, liberty is granted to the petitioner to
