In this present case, the petitioner seeks bail in connection with Nautan P.S. Case No. 364 of 2024, registered for the offences under Sections 179, 180 and 318 (4) of the BNS, 2023.

As per prosecution case, the petitioner was apprehended on suspicion on exchanging fake currency notes and from the possession of the petitioner, recovery of 11 currency notes denomination of Rs. 500/- was made.

This is the second attempt of the petitioner to seek bail from this Court. Earlier, vide order dated 05.02.2025 passed in Cr. Misc. No.1110 of 2025, the petitioner was granted regular bail while imposing a condition that if the currency

notes recovered from the petitioner were found to be fake, the bail bonds would not be accepted. This condition was imposed for the reasons that submission has been made on behalf of the petitioner that the recovered currency notes were not fake.

The learned counsel for the petitioner submits that during investigation, it has been found that notes recovered from the petitioner were found fake and, for this reason, the bail bonds of the petitioner was not accepted. The learned counsel further submits that the petitioner is 22 years old youth and is in custody since 03.10.2024 and he has no criminal antecedent and considering this fact, the bail was granted to the petitioner. The learned counsel further submits that the trial is at the stage of prosecution evidence and four witnesses out of six charge sheet witnesses have been examined and the petitioner may be given an opportunity to defend his case.

Learned A.P.P. opposes the submission made on behalf of the petitioner. The learned APP submits that notes in possession of the petitioner was found to be fake.

Having regard to the facts in totality, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned

Additional Sessions Judge-IV, Bettiah, West Champaran/ concerned court in connection with Nautan P.S. Case No. 364 of 2024, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions :

(i) One of the bailors will be a close relative of

the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

¶27

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
