Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Bheja P.S Case No. 23 of 2021 dated 25.03.2021 registered for the offence punishable u/s 147, 148, 149, 341, 323, 386, 307, 427, 504, 506 read with 34 of the Indian Penal Code and 27 Arms Act.

As per the prosecution case, the informant has alleged that he has agricultural land of about 20 Bighas in which he had cultivated Moong crops but on 25.03.2021 at about 7:00 A.M., all the named accused persons and 15 to 20 unknown persons arrived there with deadly weapons and tractors and destroyed standing Moong crops by tractors. that when the informant went there, then the petitioner told him why he did not pay Rs. 2,00,000 (Rupees Two Lakh) which was demanded by them as extortion money and thereafter the petitioner and the co-accused persons namely, Ramsagun Paswan and Prithvi Saday started firing indiscriminately.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is land dispute between the parties. There is general and omnibus allegation against the petitioner. Learned counsel for the petitioner has further submitted that the petitioner has not committed any offence and he has never demanded Rs. 2,00,000/- (Rupees Two Lakh) as extortion money. The petitioner has no concern with the alleged occurrence. The petitioner has 8 criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 27.01.2025. The co-accused person has already been granted anticipatory bail by this Court vide order dated 25.01.2024 passed in Cr. Misc. No. 79869 of 2023.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Bheja P.S Case No. 23 of 2021, with a condition:-

(i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
