The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 448 & 307 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, while the informant was sleeping in his house, this petitioner alongwith two other co-accused and ten unknown persons entered in his house and tried to forcibly obtain his signature on papers and on protest, they assaulted him. It is further alleged that this petitioner fired from his pistol, but fortunately the bullet hit the wall of the courtyard and no one sustained fire-arm injury.

Learned counsel for the petitioner submits that due to land dispute between the parties, this false and concocted case has been lodged. As a matter of fact, the informant has already executed power of attorney for sale of land in favour of petitioner and others and later on, due to hike in prices, the informant has lodged this false case. Though, there is allegation of firing against this petitioner, but nobody sustained any firearm injury.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Sonpur P.S. Case No. 119 of 2013, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
