The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code read with Section 7 of the Essential Commodities Act, 1955.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a PDS dealer and based on the direction of the Sub-Divisional Officer, Samastipur, the instant FIR was instituted alleging that petitioner is involved in corrupt practices and black marketing of government food grains materials, further upon physical verification of the godown of the petitioner, 176.52 quintals of

wheat along with 265.24 quintals of rice was found missing from the godown .

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that the godown of the petitioner was inspected at a time when the same was under renovation and the wheat and rice was shifted to a different godown , but then the authorities are not willing to listen to the petitioner and it was presumed that wheat and rice has been sold in black market. It is further submitted that the PDS license of the petitioner was also suspended by order dated 28.05.2024 against which the petitioner had moved this Court by filing CWJC No. 12140 of 2024 and the same came to be allowed by an order dated 05.10.2024 passed by a learned Co-ordinate Bench and the authorities were directed to restore the supply without any undue delay. It is also submitted that petitioner will not abscond rather will co-operate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Musrigharari P.S. Case No. 177 of 2023 subject to the conditions as laid down under Section 482 (2) of BNSS.

However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not co-operating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.

Let a copy of this order be sent to the concerned police station through the learned Trial Court.

9. Accordingly, the instant anticipatory bail application stands allowed.
