The petitioner seeks bail in connection with Kasba P.S. Case No. 75 of 2024 instituted for the offence punishable under Sections 392 and 411 of the Indian Penal Code.

As per the FIR, it is alleged by the informant that he is the organizer of C.S.P. of S.B.I., Sanjheli in the name of his brother Md. Kashif Alam. On 21.03.2024 the informant came at Kasba S.B.I. Branch and withdrew total Rs. 11,82,100/from the account of his brothers Md. Kashif Alam and Md. Ashif Alam and one Md. Nastar Kamil and after withdrawing the aforesaid amount, the informant along with one Abdul Barik was going to Kushaha chowk on his Platina motorcycle. In the way at about 5.30 PM., when they reached near mango orchard,

suddenly, two persons on a motorcycle came there and on the point of pistol snatched the bag containing from his possession and fled away.

Learned counsel for the petitioner submits that the FIR has been lodged against unknown accused persons. During investigation, co-accused Munna Kumar and Bechan Kumar were arrested and both the accused persons disclosed the name of the petitioner and on that basis petitioner has been made accused. It has been submitted that the seized currency notes of Rs. 2 lacs have been recovered from the house of the petitioner where co-accused, Md. Sahid, who is the brother-in- law of the petitioner, was present at that time. Petitioner has no role in the said crime. Learned counsel for the petitioner submits that coaccused Munna Kumar has been granted bail by the learned lower Court itself. The petitioner is in custody since 21.09.2024 having no criminal antecedent.

On the other hand, learned counsel for the State vehemently opposed the prayer for bail and submitted that from the room of the house of this petitioner 400 currency notes of Rs. 500/- total rupees two lakhs and Aadhar Card of informant have been recovered which were kept beneath the bed of the petitioner as well as one black pulsar motorcycle which was

Considering the aforesaid, I am not inclined to

grant bail to the petitioner at this stage.
