the petitioner, Mr. N. N. Tiwari, learned APP for the State, Mr. Pramod Kumar Singh, learned counsel for the informant and perused the case diary.

Earlier anticipatory bail of the petitioner was rejected vide order dated 30.10.2024 passed in Cr. Misc. No. 75084 of 2024 (Annexure- P1).

The petitioner seeks bail in connection with Benibad P.S. Case No. 24 of 2024, instituted for the offences punishable under Sections 341, 323, 325, 307, 302, 427 and 34 of the Indian Penal Code.

The prosecution case, in short, is that the petitioner along with other co-accused persons assaulted the informant and her father-in-law due to which the father-in-law of the informant died in course of his treatment.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that both the parties are agnates. The allegation levelled against the petitioner is general and omnibus in nature. It is further submitted that there was no intention of the petitioner to kill the deceased. The petitioner is in custody since 21.01.2025 and has got no criminal antecedent.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing

bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Benibad P.S. Case No. 24 of 2024.
