Khirimore P. S. Case No. 77/2022 in a case registered for the offences punishable under Sections 376, 506/34 of the Indian Penal Code and Section 67/66 (E) of the Information Technology Act.

It is alleged that on false promise of marriage, this petitioner established physical relationship with the informant and later, refused to solemnize marriage. It is further alleged that when father of the informant solemnized her marriage with another person, this petitioner along with other F.I.R. named accused persons made obscene video and photos of the

informant viral as a result of which, she was ousted from the matrimonial house by her in-laws.

Learned counsel for the petitioner submits that from bare perusal of the F.I.R. it is apparent that informant was married at the time when both of them were friends. The relationship between the parties was consensual and continued for two years and the same has been given colour of sexual exploitation only with an oblique motive. During investigation, it has come that the mobile number given by the informant, on which the alleged video was received, was found to be registered in the name of one Nitish Kumar, Buxar. Petitioner is in custody since 04.07.2024. Charge-sheet has already been submitted.

Learned A.P.P. for the State vehemently opposes the bail application.

Considering the aforesaid facts and circumstances of the case, period of custody and the fact that charge-sheet has been submitted, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-1, Patna in
