Heard Mr. Tribhuwan Narayan, learned counsel for

the petitioner, Mr. Parwej Khan, learned counsel for the Informant and Mr. Manoj Kumar, learned APP for the State.

The petitioner is apprehending his arrest in connection with Bhabhua P.S. Case No. 787 of 2024, F.I.R. dated 01.10.2024 registered for the offences punishable under Sections 316(2), 3(5), 318(4) and 319(2) of B.N.S.

Allegation against the petitioner is that he along with other co-accused persons have taken amount of Rs. 9,84,200/- (Nine Lacs Eighty Four Thousand and Two Hundred) from the informant to provide a job in the Railway Department to his both nephews of the informant.

petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R. As per allegation in the F.I.R. the petitioner and other coaccused persons have taken amount of Rs. Rs. 9,84,200/- (Nine Lacs Eighty Four Thousand and Two Hundred) from the Informant for proving a job in the Railway Department to his both nephews of the informant and the petitioner is not ready to return the amount in question.

Learned counsel for the Informant as well as learned APP for the State, on the other hand, opposed the prayer for anticipatory bail of the petitioner and submits that the petitioner and other co-accused persons have grabbed the amount in question and apart from that anticipatory bail of coaccused person namely Shivam Singh has been rejected by a Coordinate Bench of this Court vide order dated 09.05.2025 passed in Cr. Misc. No. 6330 of 2025 and the case of the petitioner is of similar nature.

Considering the aforesaid facts that the petitioner is named in the F.I.R. and apart from that he has taken amount from the Informant and the bail application of similarly situated

co-accused person has been rejected by a Coordinate Bench of this Court, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Bhabhua P.S. Case No. 787 of 2024 pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabhua.
