Heard learned counsel for the petitioners and learned

2 . The petitioners have preferred this application for grant of regular bail in connection with Karwandiya P.S. Case No. 24 of 2024 dated 30.10.2024 registered for the offences punishable u/ss 115(2), 127(1), 109, 103(1) read with section 3(5) of the BNS.

3 . As per the prosecution case, the petitioners and the co-accused persons are alleged to have assaulted the informant’s handicapped sister with lathi, danda, fists and legs with intention to kill her causing severe injuries to her. Later on she

died, during the course of the treatment.

4 . Learned counsel for the petitioners has submitted

that the petitioners are innocent and have falsely been implicated in this case. There is a delay of four days in lodging the FIR. There is general and omnibus allegation against the petitioners. The petitioners are the Gotia of the husband of the deceased and they have no concern with the alleged offence. The petitioner no. 1 has one criminal antecedent and the petitioner no. 2 has clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 19.11.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners by submitting that the daughter of the deceased has confessed that the petitioners and the co-accused persons assaulted her mother due to that she got severely injured. As per the postmortem report, the cause of death is Cardiac Arrest due to Haemorrhage skull.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Sasaram, Rohtas in connection with

Karwandiya P.S. Case No. 24 of 2024, with following condition/s:-

( i ). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
