Case No. 92 of 2024 dated 20.02.2024, registered under Section 302 read with Section 34 of the Indian Penal Code. The prosecution alleged that co-accused persons killed the informant's daughter over a property dispute. 2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 1477 of 2024 arising out of Gopalpur P.S. Case No. 92 of 2024 dated 20.02.2024 registered for the offences punishable under Section 302 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the informant alleged that the co-accused persons killed his daughter due to property dispute. It is further alleged that earlier also the scuffle took place between the deceased and the co-accused persons with the intent of usurping the property.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has come in this case during the course of investigation. No TIP has been conducted by the prosecution. The charge-sheet has already been submitted against the petitioner. It is further submitted that the only allegation against the petitioner is of catching hold of the deceased, thereafter the co-accused Jay Kumar fired on the deceased. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.02.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Sessions Trial No. 1477 of 2024 arising out of Gopalpur P.S. Case No. 92 of 2024 with a condition:-
