Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence under Sections 419/420 of the Indian Penal Code and Section 10 of the Bihar Examination Act.

As per prosecution case, on 02.03.2017, during an examination in Room No. 22, one Vikash Kumar was caught impersonating as Dharmendra Kumar in Local K.S.T. College, Noorsarai, District - Nalanda.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He is a poor person, resides in Patna and has got no concern either with the alleged examination or said Vikash Kumar. Petitioner is a private taxi driver and has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer

for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge 9^th , Nalanda, Bihar Sharif in connection with Noorsarai P.S. Case No. 40 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
