Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No. 472 of 2024 arising out of Rupauli P.S. Case No. 310 of 2023 instituted for the offences under Sections 302/201/120B of the Indian Penal Code.

Earlier vide order dated 31.07.2024 passed in Cr. Misc. No. 33167 of 2024 the prayer for grant of bail to the petitioner was rejected.

Allegation against the accused persons is of committing murder of the informant’s son after kidnapping him.

Learned counsel for the petitioner mainly submitted that the petitioner has been languishing in jail since 12.12.2023

and there is no significant progress in the trial. Learned counsel further referring to supplementary affidavit submitted that there are eight charge-sheeted witnesses but not a single witness has been examined till date and there is no likelihood of conclusion of trial in near future and therefore, petitioner may be released on bail. He further contended that prolonged pretrial detention of the petitioner without likelihood of conclusion of trial in near future is infringement of her personal liberty as guaranteed under Article 21 of the Constitution of India. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, petitioner being lady as also there being no significant progress in the trial coupled with the fact that petitioner has been languishing in jail for the last more than one and half year, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sessions Trial No.
