2. The petitioner has preferred this application for grant of regular bail in connection with Jurawanpur P.S. Case No. 156 of 2024 dated 06.09.2024 registered for the offences punishable under Sections 103(2) and 61(2) of B.N.S.

As per the prosecution case, the informant alleged that on 05.09.2024 at 7:00 AM, a panchayat meeting was held to resolve a land dispute running in between the informant’s family and one, namely, Rajeshwar Rai, in which ten accused persons, including the petitioner assaulted the informant, his father and his uncle by means of lathi and iron rod due to which his father succumbed to his injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the

petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. Learned counsel has further submitted that as per the post-mortem report of the deceased, the caused of death is due to Cardiac Respiratory failure. The co-accused persons have already been granted regular bail by this court vide order dated 10.07.2025 passed in Cr. Misc. No. 28197/2025. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Jurawanpur P.S. Case No. 156 of 2024.
