Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the O.P. No.2 has also appeared.

The petitioner seeks bail in connection with Woman P.S. Case No. 27 of 2014 (T.R. Case No. 666 of 2024) instituted for the offences under Sections 498A, 341, 323, 379/34 of the I.P.C. and Section ¾ of the Dowry Prohibition Act.

As per prosecution case, the accusation has been made against the petitioner of harassing and torturing the

Informant for non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner is the husband of the Informant. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. He further submits that the petitioner is ready to keep the Informant with full dignity and honour. The petitioner has no criminal antecedent and is languishing in judicial custody since 21.08.2024 without any rhymes or reason.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Learned counsel for the Informant submits that the Informant is ready to live with the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner as also taking into account the fact that both the parties are ready to live together, let the petitioner, abovenamed, be released on bail on furnishing

bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Woman P.S. Case No. 27 of 2014 (T.R. Case No. 666 of 2024), subject to the condition that both the parties shall file a joint affidavit at the time of furnishing bail bond before the learned court below to the effect that the parties have agreed to live together.
