The petitioners apprehend their arrest in connection with Barh P.S. Case No. 694 of 2024 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

As per the FIR on 22.09.2024 during patrolling duty the police party got the information that some accused persons are selling wine in their house. On such information police raided the house Sona Ram i.e. father of the petitioners. After seeing the police party, two persons started fleeing away after leaving the bags. On search 29.5 litres of liquor has been recovered from the bags left by the persons.

Learned counsel for the petitioners submit that the petitioners have falsely been implicated in this case on the basis of disclosure of their name by the people residing in the locality. As per the seizure list recovery has been made from vacant land situated in front of the house of the petitioners father and not from inside his house.

Regards being had to the submissions advanced by learned counsel for the parties and taking into consideration the fact that the liquor has not been recovered from the conscious and premises belonging to the petitioners, let the petitioners above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barh P.S. Case No. 694 of 2024, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.
