Case No. 01 of 2024 dated 23.08.2024 (District Rohtas), registered for offences punishable u/ss 309(6), 103, 61(2) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act. Prosecution case: on 22.08.2024 the informant's son (Suraj Soni) was shot dead near Bajrangbali Mandir while returning home after closing his shop, and the bag containing 150 gms. of gold, 7 kg. of silver and Rs. 20,000/- in cash was taken away; post-mortem cause of death recorded as haemorrhage and shock due to firearms injury. Counsel for the petitioner submitted that he is innocent, not named in the F.I.R., his name sprung up in the confessional statement of co-accused Suresh Prasad @ Suresh Chaurasia, nothing was recovered from his conscious possession, he has no criminal antecedent, and he is in custody since 20.11.2024. Learned A.P.P. opposed, relying on the confessional statement of co-accused Asgar Sah alleging that the petitioner finalised a plan to kill the deceased for Rs. 1.5 lakh and paid Rs. 50,000/- as advance to Ajit Yadav, and that co-accused Satyendra and Ajit Yadav, armed with pistols, followed and fired upon the deceased. Holding: considering the facts and circumstances and the heinous nature of the allegation against the petitioner, the court was not inclined to enlarge him on bail; the trial court was directed to expedite and conclude the trial at the earliest; the application stands rejected.

Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Baddi P.S. Case No. 01 of 2024 dated 23.08.2024 registered for the offences punishable u/ss 309(6), 103, 61(2) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.

As per the prosecution case, on 22.08.2024, the informant's son was returning to his village after closing his shop, When he reached near Bajrangbali Mandir, three unknown miscreants shot him dead. Thereafter the accused persons took away the bag of the informant's son containing 150 gms. of Gold, 7 kg. of Silver and Rs. 20,000/- in cash.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the coaccused, Suresh Prasad @ Suresh Chaurasia. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.11.2024.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the petitioner and the other co-accused persons are involved in the commission of murder of the informant's son which is evident from the confessional statement of the co-accused, Asgar Sah. The coaccused, Asgar Sah has stated that a few days before the incident, Suresh Prasad Chaurasia, Ajit Yadav and Satyendra Kumar were called to Alampur to meet the petitioner. They came to the shop of the petitioner. The petitioner explained everything to them and finalized the plan to kill the deceased for Rs. 1.5 lakh. The petitioner gave Rs. 50,000/- to Ajit Yadav as an advance and promised to pay the remaining amount after the work was done. On 22.08.2024, as per the pre-plan, the co-accused, Suresh Prasad Chaurasia, Ajit Yadav and Satyendra arrived at Alampur market at 5 P.M. The co-accused, Satyendra had a white Apache bike, a pistol and bullets. The co-accused Ajit Yadav also had a pistol and

bullets. As planned, they waited for Suraj Soni to close his shop. When Suraj Soni after closing the shop left for his home, another boy was also riding on his motorcycle with him. The accused persons started following them and the co-accused, Satyendra kicked Suraj Soni causing him to fall from his motorcycle then Ajit Yadav fired on Suraj Soni. Even after being shot, Suraj Soni caught hold of Satyendra and threw him on the ground then Ajit Yadav again shot him. Hearing the gunshot, some villagers came there and the accused persons fled away. As per the post-mortem report of the deceased, the cause of death is haemorrhage and shock due to firearms injury.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner above-named on bail.

7. Learned trial court is directed to expedite the trial and conclude the same at the earliest.
