The petitioner has preferred this application for grant of regular bail in connection with Tisiauta P.S. Case No. 59 of 2024 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 354, 379, 504, 506, 302 and 34 of the Indian Penal Code.

As per the prosecution story, the informant has alleged that on 05.06.2024 at about 08:00 P.M., one Matuk Rai was constructing pillar on the informant’s land, when he opposed, then Matuk Rai started abusing him and ordered the other co-accused person to kill him. It is further alleged that one Bipin Rai assaulted the informant by means of farsa on his head. Allegation on the present petitioner is that he assaulted the

informant by means of sword.

Learned counsel for the petitioner submits that the petitioner is languishing in custody since 23.12.2024 and the entire allegation against the petitioner is false and concocted. Nothing as alleged in the F.I.R. ever took place. From perusal of the F.I.R., it is evident that the allegation are general and omnibus. No specific role has been attributed to the petitioner. As per F.I.R., specific allegation of assault is against Bipin Rai and Matuk Rai, nothing specific has been alleged against the present petitioner. The antecedent of the petitioner is clean. Lastly, he prayed to enlarge the petitioner on bail.

Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

From perusal of F.I.R., it transpires that there is general and omnibus allegation against the petitioner. Two coaccused namely, Bhushan Rai and Ram Das have been granted anticipatory bail from the co-ordinate Bench of this Court vide order dated 23.10.2024 in Cr. Misc. No. 66016 of 2024 and one co-accused namely Matuk Rai has been granted regular bail from the co-ordinate Bench of this Court vide order dated 13.12.2024 in Cr. Misc. No. 64698 of 2024.

Keeping in view the aforesaid facts and considering

the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 59 of 2024.
