ORAL ORDER

7 18-11-2025 Heard the learned counsel for the parties.

The petitioners apprehend their arrest for the offences alleged under Sections 191(3), 190, 126(2), 115, 118(1), 109 and 352 of the BNS, registered in connection with Nayagaon P.S.Case No. 61 of 2024.

As per allegation, while the informant was standing in front of his house, the petitioners along with other accused persons came there and started abusing him. On objection, all the accused persons started assaulting the informant causing him injury on his head and when his cousin came to his rescue, the accused persons also assaulted him and the petitioner Manish Kumar robbed him of Rs. 7,300/-.

The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated. The injuries are simple in nature. There is case and

counter case and the informant has suffered simple injury. His brother Mohan Kumar has also sustained two simple injuries and about the third injury it has been mentioned that it appears to be grievous, suggesting MRI test which was not done by Mohan Kumar, so the nature of injury could not be affirmed.

On the other hand, the learned counsel for the informant and the learned APP for the State have opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Nayagaon P.S.Case No. 61 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS.
