Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 5989 (C) of 2022 registered for the offences punishable under Section 498 A of the IPC and under Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Allegation against the petitioner and his family members is that due to non-fulfillment of demand of dowry they tortured and assault the complainant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the complainant is residing in her parental home and despite taking all efforts to bring her back she refused to live

with the petitioner. He further submits that two children are born from the marriage and they are living with the petitioner who is taking care of them.

Learned APP as well as learned counsel for the informant oppose the prayer for anticipatory bail of the petitioner and submits that complainant has already filed Maintenance Case No.176 of 2022 and Guardianship Case No. 25 of 2022 pending before the Principal Judge, Patna against the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/(rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Complaint Case No. 5989 (C) of 2022, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.
