This is the second attempt of the petitioner for grant of regular bail in connection with Gopalpur P.S. Case No. 95 of 2023 registered for the offence under Sections 302, 201, 376(D)A read with Section 34 of the Indian Penal Code and under Section 4, 6 of the POCSO Act. Earlier the bail application of the petitioner was rejected vide order dated 29.02.2024 passed in Cr. Misc. No. 75894 of 2023.

As per the prosecution case, the dead body of the deceased has been recovered from the house of the

The petitioner is in custody since 6.7.2023 and it has been submitted by the learned counsel for the petitioner that in the trial, out of eight charge-sheeted witnesses only one witness has been examined.

Learned counsel for the petitioner further submits that charge-sheet has been submitted under Section 306 of the Indian Penal Code and the petitioner is ready to cooperate in the trial.

Considering the aforesaid facts, this application

is allowed.
