Petitioner seeks regular bail in connection with Sikraul P. S. Case No. 45/2024 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, on the alleged date and time of occurrence, this petitioner is alleged to have caught mother of informant and shot her dead.

Learned counsel for the petitioner submits that informant is not an eye witness of the occurrence. As a matter of fact, mother of the informant had illicit relationship with one Jitendra Dubey and both of them conspired to murder her husband for which Sikraul P. S. Case No. 35 of 2023 was

lodged. As per F.I.R., this petitioner is only alleged to have facilitated the alleged occurrence and no specific overt act is alleged against him. Petitioner claims clean antecedent and he is in custody since 08.10.2024. Charge-sheet has already been submitted.

Learned A.P.P. for the State vehemently opposes the bail application.

Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District JudgeII, Buxar in connection with Sikraul P. S. Case No. 45/2024.
