2 08-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

This Cr. Misc. petition has been filed to cancel the bail of the O.P. Nos. 2 & 3 which was granted by learned Additional Sessions Judge-16, Patna vide order dated 10.08.2021 in A.B.P. No. 240 of 2021, arising out of Kotwali P.S. Case No. 240 of 2021.

Learned counsel for the petitioner submits that the O.P. Nos. 2 & 3 were granted bail by learned Additional Sessions Judge-XVI, Patna vide order dated 06.03.2020 in B.P. No. 424 of 2020 with condition that opposite parties will not try

to commit any criminal offence towards the informant in future and if the opposite parties found to be indulged in committing any offence towards the informant, the Court below shall be at liberty to cancel their bail-bond. He further submits that O.P. Nos. 2 & 3 were again indulged in criminal case bearing Kotwali P.S. Case No. 240 of 2021 in which they were granted anticipatory bail without considering the conditions as enumerated in earlier order dated 06.03.2020 passed in B.P. No. 424 of 2020. Therefore, he submits that this case may be disposed of with the liberty to the petitioner to file appropriate petition for cancellation of bail of opposite parties passed in B.P. No. 424 of 2020 before the Court concerned.

Learned A.P.P. for the State has no objection to this prayer of the petitioner.

In view of the submission of learned counsel for the petitioner, the present case stands disposed of with the liberty to the petitioner as prayed for.
