Learned counsel appearing for the appellant prays for withdrawing the present application in view of the fact that cognizance has already been taken in the complaint case and thus, the present application has become infructuous as not maintainable.

Permission is accorded and, in case, the appellant surrenders and seeks regular bail, the same shall be considered on its own merit without being prejudiced by the present withdrawal and preferably be taken up on the same day.

Accordingly, the instant appeal stands dismissed as withdrawn.
