Patna High Court (Division Bench: Mohit Kumar Shah J authoring; Shailendra Singh J concurring), judgment dated 03-07-2025, disposed together Criminal Appeals (DB) Nos. 150, 85 and 107 of 2018 arising out of Udakishunganj P.S. Case No.47 of 2005 (District Madhepura), Sessions Trial No.123 of 2006, by which the Additional Sessions Judge, Fast Track Court No.-II, Madhepura had convicted the appellants under Sections 302/34 IPC (with Section 323 IPC convictions additionally against Mritunjay Jha and Santosh Jha) and sentenced them to imprisonment for life. The Court upheld the factum of the occurrence: the eyewitness testimony (including injured witnesses Sanjeev Kumar Jha P.W.3 and Sheela Devi P.W.6, besides P.W.2, P.W.4, P.W.5, P.W.8 and the Investigating Officer P.W.7) established the date, time, place and manner of the 08.05.2005 early-morning lathi/garasa assault rooted in a homestead land dispute; post-mortem findings (death due to shock and brain injury by hard and blunt substance) were consistent with the ocular account; the defence objection on time of death was met by rigor mortis present in all four limbs indicating more than six hours had elapsed. Liability under Section 302 with the aid of Section 34 IPC was affirmed: all appellants were present together armed with lathi at about 5 a.m. with premeditated concert and common intention, the plan being capable of sudden formation. However, accepting the alternative plea, the Court found absence of intention to cause death (only knowledge that death was likely, drawing on the intent/knowledge ingredients of Section 299 IPC), altered the conviction from Section 302/34 IPC to Section 304 Part II IPC, set aside the life sentences, and imposed rigorous imprisonment of 5 years on each appellant, declining reduction merely for passage of about twenty years and clean antecedents in deference to sentencing proportionality principles. Section 323 IPC conviction was retained against Mritunjay Jha and Santosh Jha without separate sentence. Budh Narayan Jha and Mritunjay Jha were ordered released forthwith (custody exceeding five years); the bail bonds of Santosh Jha and Dheeraj Jha were cancelled with a four-week surrender direction. Appeals partly allowed.
