On the basis of the order dated 3rd September 2025 passed by this Court, the Superintendent of Police, Gopalganj, informed this Court vide letter no. 681 dated 13th September 2025, stating, inter alia , that in Criminal Appeal (DB) No. 17/1995, both appellants have died.

In view of the death of both appellants, Criminal Appeal (DB) No. 17 of 1995 abates.

It is further stated by the S.P., Gopalganj, that in Criminal Appeal (DB) No. 26 of 1995, two appellants, namely appellant no. 2, Jai Sri Ram, son of Raghubir Ram, and appellant no. 5, Ram Chander Singh, son of Shiv Shankar Singh, have died. Therefore, in view of such circumstance, Criminal Appeal (DB) No. 26 of 1995 abates as against appellant nos. 2 and 5. However, the instant appeal shall continue against appellant no. 1, R. Suresh Chaudhury; appellant no. 3, Ram Bishwas Singh; and appellant no. 4, Hari Kishun Singh.

The S.P., Gopalganj, also submitted in his report that in Criminal Appeal (DB) No. 33 of 1995, the sole appellant,

Bacha Rai, has expired; therefore, this appeal also abates as against the sole appellant, namely Bacha Rai.

Thus, the Office is directed to note the abatement of the entire Criminal Appeal (DB) No. 17 of 1995 and Criminal Appeal (DB) No. 33 of 1995. Criminal Appeal (DB) No. 26 of 1995 shall continue against the three named appellants who are alive, along with Criminal Revision No. 97 of 1995.

On perusal of the office notes, we find that the dealing officer made a note stating the wrong number of Criminal Appeal (DB) No. 33 of 1995, recording it as Criminal Appeal (DB) No. 37 of 1995. Thus, the concerned dealing officer and Section Officer are cautioned and directed to be vigilant in the future when mentioning the number of appeals in office notes.
