Heard learned counsel for the petitioners as well as learned senior counsel appearing on behalf of the respondents.

Learned senior counsel appearing on behalf of the respondents submits that Partition Suit No. 240 of 2013 (CIS No. 390 of 2013) has been disposed of with preparation of final decree and as such the present case has become infructuous.

Faced with the situation, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to seek his remedy before appropriate forum.

Permission is accorded.

Accordingly, the present petition stands dismissed as withdrawn with liberty to the petitioners to take recourse of law available to them before appropriate forum for redressal of their grievances.
