Heard learned counsel for the petitioners, learned Additional Advocate General, Mr. Khurshid Alam and the learned Senior Counsel appearing on behalf of the private respondent, Mr. K.N Choubey.

The learned counsel for the petitioners at the outset submit that the instant writ application has been filed seeking quashing of the order dated 07.03.2024 passed by the Collectorcum-District Magistrate, Kaimur, Bhabhua in Misc. (Ceiling) Case No.47 of 2021 whereby the Collector has directed for cancellation of Jamabandi and rent receipt of the petitioners who are landless persons and were settled on the surplus land declared in a ceiling case.

The learned counsel for the petitioners but then fairly submits that the order dated 07.03.2024 passed in Misc. (Ceiling) Case No. 47 of 2021 passed by Collector was

challenged before this Court in CWJC No.10186 of 2024 and the same was allowed by an order dated 25.07.2024 and the order of the Collector dated 07.03.2024 was quashed and the matter was remanded back to the Collector, on which the learned A.A.G submits that since the order impugned is no more in existence, as such the instant writ application has become infructuous.

At this stage, the learned counsel for the petitioners seek permission to withdraw the writ application with liberty to move at an appropriate stage, if required.
