2 15-01-2024 Heard Mr. Manoj Kumar, learned counsel appearing on behalf of the petitioner and Mr. Savesh Kumar Singh, learned AAG-13 for the State.

Learned counsel appearing on behalf of the petitioner submits that petitioner will avail remedy under Section 157 of the Bihar Panchayat Raj Act, 2006 before the District Magistrate, Bhojpur at Ara, for the relief(s) as prayed for in the present writ petition.

Considering the limited relief(s) sought by the petitioner, the District Magistrate, Bhojpur at Ara, is directed to call for the records relating to the Panchayat Samiti, Block-

Piro, and after providing opportunity of hearing to the affected parties, the District Magistrate take a final decision with respect to the special meeting, which is proposed to be held on 16.01.2024, in accordance with law by passing a speaking order.

The special meeting dated 16.01.2024 shall lose its operation till final decision is taken by the District Magistrate.

As the order has been passed in open Court, Mr. Savesh Kumar Singh, learned counsel for the State has ensured that he will immediately communicate the District Magistrate, Bhojpur at Ara, by both the means, fax, as well as, by telephonic communication, even before the order is pronounced.
