Heard the parties.

Learned Advocate for the petitioner while pressing the writ petition contended before this Court that the land, in question, appertaining to Khata Nos. 106 and 107, Survey Plot Nos. 595, 596 and 388 having an area 15 katha 7 dhur belongs to ancestors of the petitioner, over which he has been coming in peaceful possession since long. A residential house has also been constructed over the land, in question, and the petitioner has left some portion to use as sahan .

Jamabandi No. 32/230 was created in the name of the ancestors of the petitioner and the petitioner has been paying rent regularly to the State. It is further contended that despite the aforesaid facts, some of the persons in connivance with Anchal

Staff has created a new Jamabandi No. 569 carving out some of the area from old existing Jamabandi No. 32 of 230 without issuance of any notice to the petitioner.

Learned Advocate for the State refuting the contention of the petitioner contended that if the petitioner has any grievance with regard to the new Jamabandi No. 569, he has the remedy for cancellation of the same before the Additional Collector under Section 9 of the Bihar Land Mutation Act.

In view of the submissions advanced on behalf of the learned Advocate for the respective parties, this Court deems it proper to dispose of the writ petition with a liberty to the petitioner to approach before the Additional Collector for redressal of his grievance.

The writ petition stands disposed of.
